2010 Municipal Election
- Election Information for Candidates -

Nomination Procedure:

  Nomination papers for qualified candidates running for the Municipal Election (Lord Mayor, Councillor, and Regional Councillor) may be filed with the Town Clerk at the Town Administration Building, 1593 Four Mile Creek Road, Virgil.

  Nomination papers for the School Board Election should be submitted to the municipalities listed under the Offices to be Elected page.  The Town of Niagara-on-the-Lake cannot accept these forms.


Forms will be accepted on the following days:

  Between January 4, 2010, and September 9, 2010, during normal office hours (Monday to Friday, 8:30 a.m. to 4:30 p.m.) (Please call ahead to confirm the Town Clerk's availability), and

  Nomination Day, September 10, 2010, from 9:00 a.m. to 2:00 p.m.


Additional information when filing a nomination form:

  Candidates are required to show proof of identity and qualifying address, including proof of Canadian citizenship (e.g. birth certificate, passport, citizenship card) at time of filing.

  Each candidate must pay a filing fee of $200 for the office of Lord Mayor, or $100 for all other offices. This fee is payable by certified cheque, cash, or money order payable to the Town of Niagara-on-the-Lake.

  Either the candidate or agent of the candidate must file the nomination paper in person. The declaration section of the nomination form must be signed by the candidate and sworn/affirmed before a Commissioner of Oaths. The Town Clerk can administer this oath.

  Only original nomination papers will be accepted.  The nomination paper may not be faxed, mailed, or e-mailed. Either the candidate or the agent must bring the completed and signed nomination papers to the office of the clerk. The candidate may be required to show proof of identity and qualifications.

  Candidates are also required to complete a Declaration of Qualifications at the same time as filing their Nomination Paper. If an agent is filing the Nomination Paper on behalf of a candidate, the candidate's declaration of qualification must be commissioned prior to the agent filing the paper with the Town. The agent must also provide a copy of the candidate's identification as well as providing their own identification. If either the nomination paper or the declaration of qualification is not commissioned prior to filing, the Town Clerk will NOT accept the documentation.

  On or prior to 4:00 p.m. on Monday, September 13, 2010, the Town Clerk will examine each nomination filed and, if satisfied the person is qualified to be nominated and that the nomination complies with the Act, the Town Clerk will certify the nomination paper. If not satisfied, the Town will reject the nomination and as soon as possible give notice to the person who sought to be nominated and to all other candidates for that office. The Town Clerk’s decision to certify or reject a nomination is final. It is the responsibility of each candidate to ensure he or she is qualified to run for the office for which the nomination is filed.

  In the event there are insufficient numbers of certified candidates to fill all positions available, nominations will be reopened for the vacant positions only on Wednesday, September 15, 2010, between the hours of 9 a.m. and 2 p.m.  Such additional nominations, if required, may be filed in the office of the Clerk.

 

Election Contributions and Expenses

  A candidate will receive a refund for filing a nomination paper if he or she receives more than 2 percent of the votes in the election, is elected to office, or withdraws his or her nomination.

  Candidates must file a nomination form prior to raising campaign funds or incurring campaign expenses.

  The last day for a candidate to withdraw his/her nomination form is 2 p.m. on September 10, 2010. The candidate’s campaign period commences at the time his/her nomination form is filed and ends on December 31, 2010.
