Open Air Burns In order to obtain approval from the Niagara-on-the-Lake Fire Department for open air burns, the following guidelines must be met or specific exemptions given by the Chief Fire Official in writing may be granted.
| 1. | Please call the Town of Niagara-on-the-Lake Fire & Emergency Services at 905-468-3266 prior to having an open air burn. |
| 2. | Smoke shall not pass over any road and/or highway so as to decrease the visibility of on-coming traffic. |
| 3. | Burning is not permitted on the municipal road allowance and/or below overhead cables and wires. |
| 4. | Any odour and/or smoke to such extent or degree as to cause discomfort to persons, or hazards of health, cause loss of enjoyment of normal use of property in the immediate area. |
| 5. | A controlled burn shall not be started when wind conditions exist over 15 miles per hour, so as to cause any or all of the above. |
| 6. | The fire must be supervised at all times. |
| 7. | A controlled burn shall be extinguished one (1) hour before sunset and will not be started before sunrise. |
| 8. | Means of extinguishment must be provided, i.e. brooms, backhoe, water hose. |
| 9. | A controlled burn shall not be started within 150 feet (50 metres) of any building, structure, fence, or other combustible material. |
| 10. | Open air burning shall be restricted to the burning of brush only. Note: No household waste, construction material or any other material harmful to the environment. |
| 11. | Any person setting a fire will be responsible for their actions and may be charged by the Fire Department for their services in the event of an emergency. |
